Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Questifier, LLC (“Ghosters”, “we”, “us”, or “our”) governing your use of the Ghosters website, relay service, and desktop client (together, the “Service”). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service (and at least 16, or the minimum age of digital consent in your country, if you are in the EEA or UK). By using the Service you represent that you meet these requirements and that you are able to form a binding contract.
2. What Ghosters is
Ghosters lets people who are each running their own emulator and their own game software see one another as live, non-interactive “ghost” overlays. Ghosters is not netplay and does not synchronize or modify anyone’s game. The Service exchanges only small telemetry describing game state and renders read-only, cosmetic overlays. Ghosts never affect gameplay.
3. Your account
You are responsible for the information you provide, for maintaining the security of your account and your authenticators (such as passkeys and email access), and for all activity under your account. Accounts are for a single person. Notify us promptly at support@ghosters.net if you believe your account has been compromised.
4. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of these Terms;
- harass, threaten, defame, or abuse others, or post infringing, obscene, or unlawful content (including in usernames or room names);
- impersonate any person or misrepresent your affiliation;
- interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service, its infrastructure, or other users;
- probe, scan, or test the vulnerability of the Service, or circumvent any security or authentication measures, except under a program we authorize in writing;
- use automated means to access the Service in a manner that degrades it, or reverse engineer it except to the extent that restriction is prohibited by law;
- use the Service to violate the rules of any game, competition, tournament, or platform — you are solely responsible for such compliance.
5. Games, emulators, ROMs, and third-party content
This section is important. Please read it carefully.
- Ghosters does not provide, host, distribute, sell, or link to game ROMs, BIOS files, copyrighted game assets, or emulators. We provide only the overlay/telemetry Service.
- You are solely responsible for obtaining and using your emulator and game software lawfully — including playing only games you legally own and complying with all applicable laws and with the rights holders’ terms.
- The Service transmits only small telemetry describing game state. It does not transmit game code, graphics, audio, or your save data.
- Game titles, characters, logos, and other marks are the property of their respective owners. Any references are nominative only. Ghosters is not affiliated with, sponsored by, or endorsed by any game publisher, developer, or console manufacturer.
6. Copyright and DMCA
We respect intellectual-property rights and expect our users to do the same. We will, in appropriate circumstances, disable or terminate the accounts of users who are repeat infringers.
If you believe content available through the Service infringes your copyright, send a notice to our designated agent at dmca@ghosters.net that includes, as required by 17 U.S.C. § 512(c)(3): (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material and information reasonably sufficient to locate it; (d) your contact information; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner’s behalf. If your material was removed and you believe that was a mistake, you may submit a counter-notification to the same address.
7. Your content
You retain any rights you have in content you submit (such as your username or room names). You grant us a non-exclusive, worldwide, royalty-free license to host and display that content solely to operate the Service. You are responsible for your content, and we may remove content that violates these Terms.
8. Third-party services
The Service relies on and interoperates with third-party software and platforms (for example, your emulator, your game software, our email-delivery provider, and, in the future, services such as Twitch or Discord). Your use of those third parties is governed by their own terms, and we are not responsible for them.
9. Availability and changes
The Service is provided on an evolving, best-effort basis and may be experimental. We may add, change, suspend, or discontinue any part of the Service at any time, and we do not guarantee that it will be uninterrupted, timely, secure, or error-free.
10. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY DATA OR TELEMETRY WILL BE ACCURATE OR AVAILABLE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL GHOSTERS OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify and hold harmless Ghosters and its operator from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your content, your use of emulators or game software, or your violation of these Terms or of any law or third-party right.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 5–7 and 10–15) will survive.
14. Governing law
These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in the State of Washington, United States will have exclusive jurisdiction over any dispute that is not subject to another binding resolution mechanism, subject to any mandatory consumer protections in your place of residence. Before filing a claim, you agree to first contact us at support@ghosters.net and attempt to resolve the dispute informally.
15. General
These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the Service. We may update these Terms from time to time and will revise the “Last updated” date; your continued use after changes take effect constitutes acceptance.
